An Ota Magistrates’ Court in Ogun on Monday sentenced a 20-year-old man, Kalmarudeem Faruq, to 42 months in prison for house breaking, and maliciously damaging a property worth N6 million.
Faruq was sentenced alongside an underaged person.
The convicts, whose addresses were not provided, had earlier pleaded not guilty to a four-count charge of stealing, burglary, malicious damage and conspiracy.
In her ruling, the Magistrate, Mrs O.O.Fadairo, found the convicts guilty and sentenced them without an option of fine.
Fadairo said that the prosecutor proved ibeyond reasonable doubt that the convicts were guilty of the charge brought against them.
She said that the first defendant should be taken to Ibara prison while the second, being underaged, should serve his term at Borstal Home in Abeokuta.
The magistrate added that the jail term for the underaged should start from the day of first arraignment.
Earlier, the prosecutor, Insp E.O.Adaraloye, told the court that the convicts and others at large, committed the offences between Feb.22, 2024 and Feb.23, 2024, at about 2.00 a.m.at No.5 Alhaja Shifawu,Orile,Ota.
Adaraloye said that the convicts and their accomplices broke into a house and stole a plasma TV, a cell phone and other valuable items.
He added that the convicts maliciously damaged a ceiling and aluminum window valued at N6 million in the course of breaking into the house of the complainant, one Esther Oladejo.
The prosecutor said that the offences contravened Sections 390(9) 451,413 and 516 of the Criminal Code, Laws of Ogun, 2006. (NAN)
